Important notice: Medicin is not a substitute for emergency medical services. If you are experiencing a medical emergency, call 911 immediately. Do not use Medicin for chest pain, suicidal thoughts, severe bleeding, stroke symptoms, difficulty breathing, or any life-threatening condition.

1. Acceptance of Terms

These Terms of Service ("Terms") form a legal agreement between you and Medicin.io LLC, a Delaware limited liability company ("Medicin," "we," "our," or "us"). By accessing or using the Medicin™ platform — including our website at medicin.io, mobile interfaces, and related services (collectively, the "Platform") — you agree to these Terms.

If you do not agree to these Terms, do not use the Platform. By clicking "Connect Now," submitting payment, or otherwise using the Platform, you confirm that you are at least 18 years old (or using the Platform on behalf of a minor as a parent/legal guardian), that you have read these Terms in full, and that you agree to be bound by them.

2. What Medicin Is (and Is Not)

Medicin operates a technology infrastructure platform that connects patients seeking care with independent, licensed healthcare providers. Medicin provides:

Medicin does not practice medicine, provide medical advice, diagnose conditions, or prescribe medications. All clinical decisions are made independently by the licensed provider you are connected with.

3. Eligibility

To use Medicin as a patient, you must:

Providers on the Platform are governed by a separate Provider Services Agreement and must meet additional eligibility criteria, including active unrestricted licensure and malpractice coverage.

4. Fees, Payment, and Refunds

The total charge for using the Platform is $150 per session, structured transparently as:

Payment is due at the time of booking and is processed by Stripe, Inc. We accept major credit cards, debit cards, Apple Pay, Google Pay, and HSA/FSA cards where the issuing bank supports them.

Refund policy:

To request a refund, email support@medicin.io within 7 days of the session. We respond within 2 business days.

HSA/FSA use: Medicin sessions are generally eligible for reimbursement from Health Savings Accounts and Flexible Spending Accounts under IRS Publication 502 as "fees for medical services." You will receive an itemized receipt after each session that you can submit to your plan administrator. We do not guarantee reimbursement — eligibility depends on your specific plan.

5. Emergencies — Not a 911 Alternative

Medicin is not intended for emergencies. If you are experiencing any of the following, call 911 or go to an emergency room immediately:

When using Medicin, you agree to:

Violations may result in refusal of service, account suspension, and/or legal action.

7. Your Relationship with Providers

The providers on the Medicin platform are independent healthcare professionals, not employees or agents of Medicin. They:

The professional relationship between you and a provider exists solely between you and that provider. Medicin does not supervise, direct, or participate in clinical decision-making.

If you have a clinical concern, complaint, or potential malpractice claim, that matter is between you and the individual provider (and their malpractice carrier). Medicin is not liable for the clinical care provided.

8. Intellectual Property

The Medicin™ name, logo, and all content on the Platform — including code, design, text, and graphics — are owned by Medicin.io LLC and protected by US copyright and trademark law.

You receive a limited, revocable, non-exclusive, non-transferable license to access and use the Platform for personal use consistent with these Terms. You may not:

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." To the fullest extent permitted by law, Medicin disclaims all warranties, express or implied, including but not limited to:

Medicin verifies providers' NPI numbers against the federal registry but does not guarantee the clinical competence, outcomes, or professionalism of any individual provider.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  1. Medicin shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of the Platform
  2. Medicin's aggregate liability to you for all claims arising from or related to the Platform shall not exceed the total fees you paid to Medicin in the 12 months preceding the claim, or $500, whichever is greater
  3. Medicin is not liable for any harm, injury, misdiagnosis, missed diagnosis, adverse outcome, or other consequence arising from clinical care provided by independent providers on the Platform
  4. Medicin is not liable for any harm arising from your failure to seek emergency care when appropriate

Some jurisdictions do not allow certain limitations — in those jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Medicin.io LLC, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

12. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute arising out of or relating to these Terms or your use of the Platform shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, held in Delaware or a mutually agreed remote venue.

Class action waiver: You agree that any claims will be brought only in your individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

Exceptions: Either party may bring claims in small claims court, may seek injunctive relief in court to protect intellectual property or confidential information, and may pursue claims involving allegations of medical malpractice in a court with appropriate jurisdiction (as such claims fall outside the scope of arbitrable commercial disputes).

Opt-out: You may opt out of arbitration by emailing legal@medicin.io within 30 days of first accepting these Terms. Your opt-out must include your name, account email, and the statement "I opt out of arbitration."

13. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including but not limited to violations of these Terms, suspected fraud, or risk to other users. Upon termination:

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. For any claims not subject to arbitration under Section 12, the exclusive jurisdiction and venue is the state and federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
