1. Acceptance of Terms
These Terms of Service ("Terms") form a legal agreement between you and Medicin.io LLC, a Delaware limited liability company ("Medicin," "we," "our," or "us"). By accessing or using the Medicin™ platform — including our website at medicin.io, mobile interfaces, and related services (collectively, the "Platform") — you agree to these Terms.
If you do not agree to these Terms, do not use the Platform. By clicking "Connect Now," submitting payment, or otherwise using the Platform, you confirm that you are at least 18 years old (or using the Platform on behalf of a minor as a parent/legal guardian), that you have read these Terms in full, and that you agree to be bound by them.
2. What Medicin Is (and Is Not)
Medicin operates a technology infrastructure platform that connects patients seeking care with independent, licensed healthcare providers. Medicin provides:
- A secure, HIPAA-compliant voice bridge connecting patients to providers
- Payment processing for a flat platform access fee
- Provider credential verification via the federal NPI registry
- Administrative session records and receipts
Medicin is NOT:
- A healthcare provider, medical practice, or clinical facility
- A substitute for in-person medical care, emergency services, or ongoing primary care
- An insurance provider, insurance broker, or claims processor
- The employer, agent, or supervisor of the providers on the Platform — providers are independent contractors
- A pharmacy, prescription service, or lab
Medicin does not practice medicine, provide medical advice, diagnose conditions, or prescribe medications. All clinical decisions are made independently by the licensed provider you are connected with.
3. Eligibility
To use Medicin as a patient, you must:
- Be at least 18 years old, OR be a parent/legal guardian using the Platform on behalf of a minor
- Be physically located in the United States at the time of the consultation
- Provide accurate, complete information during intake
- Not be prohibited from using telehealth services by applicable law
Providers on the Platform are governed by a separate Provider Services Agreement and must meet additional eligibility criteria, including active unrestricted licensure and malpractice coverage.
4. Fees, Payment, and Refunds
The total charge for using the Platform is $150 per session, structured transparently as:
- $100 Platform Access Fee — paid to Medicin for technology infrastructure, connection bridge, payment processing, and administrative services
- $50 Provider Consultation Fee — paid directly to your independent provider for the clinical consultation
Payment is due at the time of booking and is processed by Stripe, Inc. We accept major credit cards, debit cards, Apple Pay, Google Pay, and HSA/FSA cards where the issuing bank supports them.
Refund policy:
- If no provider accepts your session within 60 minutes of payment, you are entitled to a full refund
- If a provider accepts and contacts you, the Platform Access Fee ($100) is non-refundable — the platform service has been delivered
- If you believe the Provider Consultation Fee ($50) is owed back due to clinical dispute, you must address this directly with the independent provider (not with Medicin)
- Technical failures on our end (bridge not connecting) entitle you to a full refund
To request a refund, email support@medicin.io within 7 days of the session. We respond within 2 business days.
HSA/FSA use: Medicin sessions are generally eligible for reimbursement from Health Savings Accounts and Flexible Spending Accounts under IRS Publication 502 as "fees for medical services." You will receive an itemized receipt after each session that you can submit to your plan administrator. We do not guarantee reimbursement — eligibility depends on your specific plan.
5. Emergencies — Not a 911 Alternative
Medicin is not intended for emergencies. If you are experiencing any of the following, call 911 or go to an emergency room immediately:
- Chest pain, shortness of breath, or suspected heart attack
- Symptoms of stroke (facial droop, arm weakness, speech difficulty)
- Severe bleeding, trauma, or head injury
- Suicidal thoughts or intent to harm yourself or others
- Severe allergic reactions or anaphylaxis
- Overdose or poisoning
- Loss of consciousness
- Any rapidly worsening medical condition
For mental health crisis support, call or text 988 (Suicide and Crisis Lifeline). If you are in immediate danger, call 911.
6. Your Obligations
When using Medicin, you agree to:
- Provide accurate, truthful information during intake
- Not impersonate another person or submit false identity information
- Not use the Platform for any illegal purpose, including obtaining controlled substances unlawfully
- Not attempt to reverse engineer, scrape, or exploit vulnerabilities in the Platform
- Not record or transmit audio/video of your consultation without the provider's explicit consent
- Not use the Platform on behalf of someone else without proper legal authority (except as a parent/guardian of a minor)
- Respect the provider's time and professional judgment
Violations may result in refusal of service, account suspension, and/or legal action.
7. Your Relationship with Providers
The providers on the Medicin platform are independent healthcare professionals, not employees or agents of Medicin. They:
- Practice under their own licenses and malpractice insurance
- Make all clinical decisions independently
- Maintain their own clinical records (Medicin does not store clinical records)
- Are solely responsible for the clinical care they provide
The professional relationship between you and a provider exists solely between you and that provider. Medicin does not supervise, direct, or participate in clinical decision-making.
If you have a clinical concern, complaint, or potential malpractice claim, that matter is between you and the individual provider (and their malpractice carrier). Medicin is not liable for the clinical care provided.
8. Intellectual Property
The Medicin™ name, logo, and all content on the Platform — including code, design, text, and graphics — are owned by Medicin.io LLC and protected by US copyright and trademark law.
You receive a limited, revocable, non-exclusive, non-transferable license to access and use the Platform for personal use consistent with these Terms. You may not:
- Copy, modify, or distribute any part of the Platform
- Use Medicin branding in your own marketing without written permission
- Create derivative works from our content or code
- Remove any copyright or trademark notices
9. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." To the fullest extent permitted by law, Medicin disclaims all warranties, express or implied, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- Any warranty regarding the accuracy, completeness, or reliability of any information provided through the Platform (whether by Medicin or by providers)
- Any warranty that the Platform will be error-free, uninterrupted, or secure at all times
- Any warranty regarding the quality, qualifications, or conduct of any individual provider
Medicin verifies providers' NPI numbers against the federal registry but does not guarantee the clinical competence, outcomes, or professionalism of any individual provider.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- Medicin shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of the Platform
- Medicin's aggregate liability to you for all claims arising from or related to the Platform shall not exceed the total fees you paid to Medicin in the 12 months preceding the claim, or $500, whichever is greater
- Medicin is not liable for any harm, injury, misdiagnosis, missed diagnosis, adverse outcome, or other consequence arising from clinical care provided by independent providers on the Platform
- Medicin is not liable for any harm arising from your failure to seek emergency care when appropriate
Some jurisdictions do not allow certain limitations — in those jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Medicin.io LLC, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any third party's rights
- False or misleading information you provide during intake
- Your clinical relationship with any provider
12. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute arising out of or relating to these Terms or your use of the Platform shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, held in Delaware or a mutually agreed remote venue.
Class action waiver: You agree that any claims will be brought only in your individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.
Exceptions: Either party may bring claims in small claims court, may seek injunctive relief in court to protect intellectual property or confidential information, and may pursue claims involving allegations of medical malpractice in a court with appropriate jurisdiction (as such claims fall outside the scope of arbitrable commercial disputes).
Opt-out: You may opt out of arbitration by emailing legal@medicin.io within 30 days of first accepting these Terms. Your opt-out must include your name, account email, and the statement "I opt out of arbitration."
13. Termination
We may suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including but not limited to violations of these Terms, suspected fraud, or risk to other users. Upon termination:
- Your right to use the Platform ends immediately
- Any pending consultations may be cancelled and refunded
- Provisions that by their nature should survive (payment obligations, disclaimers, limitations of liability, indemnification, dispute resolution) will continue to apply
You may stop using the Platform at any time. To request account deletion, see Section 13 of our Privacy Policy.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. For any claims not subject to arbitration under Section 12, the exclusive jurisdiction and venue is the state and federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
15. Miscellaneous
- Entire agreement: These Terms, together with our Privacy Policy and Platform Disclaimer, are the entire agreement between you and Medicin regarding the Platform
- Severability: If any provision is held unenforceable, the remainder of these Terms remains in effect
- No waiver: Our failure to enforce any provision is not a waiver of that provision
- Assignment: You may not assign these Terms; Medicin may assign them in connection with a merger, acquisition, or sale of assets
- Notices: We may send notices via email to the address associated with your account or by posting on the Platform
- Changes to terms: We may update these Terms; material changes will be emailed to account holders with 30 days' notice. Continued use after the effective date constitutes acceptance
- Headings: Section headings are for convenience only and do not affect interpretation
